#Overarching Principles

Only athletes recognised as being Olympic or World Class prospects by their governing bodies will be eligible to participate in the programme.

Supporters need to be aware that meeting the above criteria does not guarantee an Athlete’s participation in the Olympics or World Championships but will ensure that the supporter’s assistance is directed at our most promising athletes.

Each TeamedUp programme is different and will be tailored to each Supporter’s specific requirements. Each programme comprises a single or multiple ‘events’.

#Booking Arrangements

Once we have a signed off programme, Supporters shallpay the agreed fee* to TeamedUp prior to the firstevent agreed as part of the programme.

* This fee comprises the Athlete fees and the TeamedUp fee but these can be invoiced separately if supporters wishto use different budgetse.g. CSR for the athletes.

If the Athlete Services have to be delayed by either party, the intention would always be to rearrange the relevant event. If the event had to be cancelled at the Supporter’s request more than 48 hours before the event ‘s scheduled start, the Supporter would would be requested to pay 20% of the cost. If less than 48 hours notice is given by a supporter, the supporter agrees to pay the Athlete the full fee for the Athlete Service. If an Athlete cancels an event, the Supporter would not be required to pay the relevant fee.

#TeamedUp and Athlete’s Commitment

TeamedUp and the Athlete agrees with the Supporter:

  • To provide the Supporter with a bespoke event or service, sharing best practice and insights into life as an elite athlete combining to make a memorable experience.
  • To allow Supporters to follow theathlete’s progress through timely updates (where ever possible) using social media and email
  • To advise the Supporter as soon as possible of any additional costs for arranging bespoke equipment or facilities (Agreed with the Supporter in advance)
  • To act with all due care and attention during antraining sessions or in performing the services to ensure that all reasonable steps are taken to ensure the supporter’s safety.
  • Advise the Supporter as soon as possible if the training event has to be postponed or delayed and in any event within 48 hours of the event, where possible to do so.

#Supporter’s Commitment

The Supporter agrees with the Athlete:

  • To provide TeamedUp with details of the Supporter’s professional credentials with the intention of either (i) the Supporter using all reasonable efforts to provide at least one day’s work experience at their usual place of work when asked by any Athlete participating in the programme (this must be within in a reasonable and mutually agreed timescale); or (ii) the Supporter offering the Athlete additional time for mentoring on an ad hoc basis.
  • If participation in a sport is part of the agreed programme, then participants are asked to only exercise within their capabilities and not to hold the Athlete responsible for his or her safety and well being during the training session. Participants are expected to arrange his/ her own additional insurance to cover any risks associated with the training event, as required.
  • Advise TeamedUp as soon as possible if the training event has to be postponed, delayed or cancelled.
  • To pay the balance of the agreed TeamedUpfee together with any directs costs and out-of-pocket expenses to TeamedUp and the Athlete (as agreed in advance) at the time of the event without any set-off or counterclaim.

#Terms for Supporters

Please note, that we could change these terms any time; therefore, you will need to check these terms regularly before teaming up with us. If you have any queries or do not agree with any of these terms, please discuss this with Dominic John of TeamedUp at dominic@teamedup.co.uk before using our website orworking with us.

“WE” or “TEAMEDUP” in these terms, means The Customer Solutions Consultancy Limited (trading as TeamedUp) a company registered in the UK with Company Number 6145031 whose registered office is at Summit House, 170 Finchley Road, London NW36BP.

“YOU” or “SUPPORTER” means the Business you represent and/or any employees participating in a TeamedUp event who agrees to engage with us to work with an elite British Athlete in return for an agreed level of financial support.

“ATHLETE” means any athlete that is registered with us who is identified by the Athlete’s Governing Body as performing at a world class level)and who is working as part of a TeamedUp programme.

“PROGRAMME” means the TeamedUp programme introducing Supporters to Athletes as described in this Agreement and on our website.

“AGREEMENT” means the terms set out below, including the Principles of Cooperation between Athletes and Supporters referred to in paragraph 7 below (which are incorporated by reference into this Agreement).

#Our Services

In exchange for you agreeing to engage TeamedUp, we shall provide You with the following services (the “Services”). We shall:

  • Facilitate an introduction to suitable Athlete(s) of your chosen Olympic sport(s) as part of your bespoke programmeand will take all reasonable care to ensure that the Athletes are appropriate for your needs. Once we establish availability, you may choose which Athlete(s) to work with;
  • Provide advice and support materials to assist You in making the most of your TeamedUpEvent(s);
  • Require Athletes to keep you up to date with their progress by providing You with updates on their progress in the run up to their next major competition for as long as the relationship with them is in place;
  • and Promptly observe and comply with all reasonable requests from You in respect of your participation in the Programme.

TeamedUp shall maintain public liability insurance for the duration of the Programme. However, you are responsible for taking out your own insurance as may reasonably be required in connection with participating in any Training Event.

#Your Commitment to TeamedUp

On booking a TeamedUp Event or any other Athlete Services or programme, you shall pay TeamedUp the Facilitation Deposit (at the time of booking) and you shall agree to pay the remaining fee (together with agreed expenses), at the time of delivery of the Athlete Services.

You shall pay any fees as invoiced at the time of booking.

For the duration of the Programme, You agree to only train and consult with, and support the Athletes through the Programme (rather than independently) and shall indemnify Us for any losses arising from any breach by you of this provision. You shall provide details to TeamedUp of your professional background and You are requested to use reasonable efforts to offer at least one day of work experience or professional mentoring to any Athlete in the Programme if requested to do so. In mentoring or providing work experience to any Athlete You shall treat him or her with the same care and attention as you would any individual or employee and provide career help guidance and potentially opportunities for them to consider at the end of their sporting careers.

By registering to participate in TeamedUp you also:

  • Confirm that You are acting on behalf of your employer and that all employees who might participate in a TeamedUp event are over 18.
  • Consent to Us holding, processing and disclosing your personal details to the Athletes, to the extent required by us to provide the Services. [Please note that the Athlete’s details will only be shared with You once the Athlete has agreed to work with You.]

Agree to:

  • Follow all safety instructions received in connection with the Training Event, including from the Athlete during the Training Event and You shall exercise due care and attention with all activities undertaken in conjunction with the Programme.
  • Only use the TeamedUp and Athlete’s names in the manner and form in a reasonable fashion that will not bring either Us or the Athlete into disrepute or conflict with any existing support or sponsorship arrangements that the Athlete has in place which you have been informed of;
  • Promptly communicate to TeamedUp any other support opportunities that You or any third party may be able to offer to any Athlete, and work with TeamedUp to progress such opportunities in accordance with the terms of this Agreement.

#Cancellation and Termination

If an Athlete is unable to fulfil all of the Athlete Services as agreed with the Supporter through injury, unavailability of facilities or reduced availability of the Athlete, We agree that we shall discuss with You in good faith a commensurate reduction or refund of the Facilitation Deposit. In the event that You cancel the Athlete Services on less than 48 hours notice, you will forfeit the Facilitation Deposit to Us.

At any time either You or we may terminate this Agreement on giving notice in writing, without prejudice to any rights which have accrued to either of us under this Agreement. On expiry or termination of this Agreement:

We shall remove from our database any information held by us about You and You shall destroy any confidential information and personal data held by you in respect of any Athlete or the Programme.

All of the Supporter’s Rights shall forthwith terminate and automatically revert to the Athlete; and You shall not use or exploit your previous connection with the Athlete.

#Liability

Nothing in this Agreement shall exclude or restrict either party’s liability for death or personal injury resulting from the negligence of that party in connection with this Agreement.

Under no circumstances shall TeamedUp be liable for any costs, damages, claims, actual or alleged indirect loss or consequential loss howsoever arising suffered by the Supporter, including, but not limited to, loss of profits,
anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation or any other sort of economic loss.

Our maximum aggregate liability in contract, tort, or otherwise (including any liability for any negligent act or omission) howsoever arising out of or in connection with the performance of this agreement in respect of any one or more incidents during the Programme shall be limited to a sum equal to the amount of the aggregate Training Fees paid by the Supporter up to the date of such act or omission.

#Confidentiality

Neither of us shall, without the prior written consent of the other (save as required by law), disclose to any third party any information concerning the Programme or the Athlete (either on or the date of this Agreement) that has been disclosed in confidence to the other party. We shall both ensure that we pay proper care and attention in storing and processing any such confidential information or personal data.

Programme Supporters acknowledge and agree that the fact that they are supporting the Programme may be disclosed to third parties by TeamedUp or by the Athletes in order increase awareness of the Programme amongst the general public.

The Supporter has the right to assign the benefits of any Training Event or other Athlete Services to a third party with the agreement of TeamedUp. If the beneficiary is under 18 then the Supporter (or other nominated adult) should also attend the event.

This Agreement constitutes our whole Agreement and supersedes all previous agreements between us relating to its subject matter.

If a provision of this Agreement (or part of any provision) is found by any court to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be struck out, and the validity and enforceability of the other provisions of this agreement shall not be affected.

If any dispute arises in connection with this Agreement, we both agree to try to settle the dispute by engaging in discussion with one another for a minimum 30 day period, from the date of giving notice to the other party of the dispute.

As part of our Agreement, You agree to comply with the terms and Principles of Cooperation between Athletes and Supporters, available here (a hard copy of which is available to you on request).

Athlete Services: means any services provided by the Athlete to, or through, the Supporter relating to the Athlete’s career, including without limitation attendance at events, presenting, coaching and delivering Training Events.

Facilitation Deposit: means the deposit, equal to an agreed fixed percentage of the Fee, which We shall retain at the time of You booking the Athlete Services.

Fee: means the fee (including any Facilitation Deposit) payable by the Supporter to the Athlete for the Athlete Services, as shall be agreed between TeamedUp, the Supporter and the Athlete at the time of booking the Athlete Services through the TeamedUp website (which in any event shall be a minimum of £300).

Governing Body: includes, without limitation, UK Sport, each sport’s governing body, EIS or Loughborough University.

Personal Support Sector: The market in which individual persons or groups of persons provide personal support to Athletes. This explicitly excludes any corporate sponsorship arrangements.

On completion of a Training Event, the Supporter shall (together with TeamedUp) have the exclusive right within the Personal Support Sector, to refer to their support of the Athlete up to and including the Tokyo 2020Olympics. Only if the Supporter supports the Athlete beyond this point does this right continue for the Supporter.

Availability of a hyperlink on the Athlete’s website to the Supporter’s website (with the designation “Supported by [Name of Supporter] through TeamedUp” and availability of a hypertext link on the Supporter’s website to the Athlete’s Website,with the designation “Official supporter of Elite athlete and Olympic prospect [name of athlete’] through TeamedUp”).

Training Event: Any sports training event arranged between the Supporter and Athlete pursuant to the Programme.
